PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE PEAK COMMUNITY

     What's in these terms and conditions?

These terms and conditions tell you the rules for using our website available at http://community.peak.ai/ (the Peak Community).

In these terms and conditions, any reference to: 

  • the Peak Platform is to our cloud-based Decision Intelligence platform. The Peak Platform is available to our customers, partners and affiliates to create and consume software applications. It is different and distinct from the Peak Community; and

  • Content means all information, profiles, materials, contributions, comments, posts, responses, feedback, data, submissions, ideas, hints, tips, tags, messages, recommendations, text, reports, articles, photos, music, videos, e-mail and other content.

In these terms and conditions, any phrase introduced by the terms including, include, in particular, for example or any similar expression shall be construed as illustrative and shall not limit the sense of the words preceding those terms.

Who we are and how to contact us

http://community.peak.ai/ is a website operated by Peak Ai Limited ("Peak", "we", “us” and “our”). Peak is a limited company registered in England and Wales under company number 09307701 and we have our registered office at Floor 12, Neo Building, Charlotte Street, Manchester, England, M1 4ET which is also its main trading address. Peak’s VAT number is 199 092 363.

By using the Peak Community you accept these terms and conditions and you enter into a Contract with us

By using the Peak Community website, you confirm that you accept these terms and conditions (the terms and conditions) and that you agree to comply with them and the Contract.  

These terms and conditions refer to the following additional terms, which also apply to your use of the Peak Community and along with these terms and conditions, the following together comprise the Contract between you and us:

  • our Privacy Policy. See further under our privacy policy; and

  • our Peak Community Acceptable Use Policy (at the end of this document), which sets out the permitted uses and prohibited uses of the Peak Community. When using the Peak Community, you must comply with this Peak Community Acceptable Use Policy;

If you do not agree to these terms and conditions and the Contract, you must not use the Peak Community.

When you sign up to the Peak Community for the first time and register for an account you must tick to confirm you agree to accept these terms and conditions and a Contract will be formed. You may also be required from time to time in future to click to accept the terms and conditions again. If these terms and conditions are changed or updated from time to time, those changes or updates will apply to the Contract between you and us. 

We recommend that you save a copy of these terms and conditions, the Privacy Policy and Peak Community Acceptable Use Policy for future reference.

If you are redirected to the Peak Platform or another product or service offered by Peak there will be other terms that will apply to your use of the Peak Platform and any other product or service so please review and comply them when you access the different products and services. 

Peak may make changes to these terms and conditions 

Peak may amend these terms and conditions from time to time. Every time you wish to use the Peak Community, please check these terms and conditions to ensure you understand the terms and conditions that apply at that time. These terms and conditions were most recently updated on 19 April 2022 when Peak launched the Peak Community.

Peak may make changes to the Peak Community

Peak may update and change the Peak Community from time to time to reflect changes to our users' needs, our business priorities or to account for changes in applicable laws or regulations. Peak will try to give you reasonable notice of any major changes.

Peak may suspend or withdraw the Peak Community

The Peak Community is made available free of charge. 

Peak may temporarily or permanently suspend or withdraw or restrict the availability of all or any part of the Peak Community for business, operational, legal or regulatory reasons or for anything unforeseen by Peak. Peak will try to give you reasonable notice of any suspension or withdrawal but will not be in breach of these terms and conditions if it does not give you notice in advance.

Peak may also suspend or withdraw or restrict your access to all or any part of the Peak Community if we suspect that you are in breach of these terms and conditions or any applicable law or regulation. Any temporary suspension, withdrawal or restriction could be made permanent at our discretion. 

You are also responsible for ensuring that all persons who access the Peak Community through your internet connection or account are aware of these terms and conditions and all other applicable terms, and that they comply with them. If you are a business and you grant access to the Peak Community to your employees, agents, contractors, consultants or any other third party, you are responsible for that person’s use of the Peak Community. 

If you are accessing the Peak Community on behalf of a business or if you are granted access to the Peak Community as a result of a business, for example by your employer, you must ensure your use of the Peak Community is in accordance with any terms and conditions, rules, policies and procedures to which you are subject with that business (for example, your contract of employment with the business), provided that those terms and conditions, rules, policies and procedures do not contradict with the Contract between you and us. If the terms do contradict, you must immediately stop using the Peak Community. 

Peak may transfer these terms and conditions and the Contract to someone else

Peak may transfer all or any part of our rights and/or obligations under these terms and conditions to another organisation including one of our subsidiaries. Peak will always tell you in writing if this happens and Peak will ensure that the transfer will not affect your rights under the Contract.

The Peak Community is available online but you should only access it if your use of the Peak Community does not breach any laws or regulations in your location

The Peak Community has been created in the United Kingdom and Ireland. Peak does not represent that the Peak Community will be available in other locations. By continuing to access, view or make use of the Peak Community and any related Content and services, you hereby warrant and represent to us that you are located in a territory where the law does not prohibit you from accessing the Peak Community. If for any reason you are located in a territory where the law prohibits access to the Peak Community, you must immediately discontinue use of the Peak Community and any related Content and services.

It is your responsibility to ensure that:

  • you obtain and maintain all necessary licences, permissions and consents which may be required for you to use the Peak Community before the date on which you access the Peak Community and for the duration of your use of the Peak Community; and

  • you comply with all applicable laws and regulations in relation to the Peak Community.

In addition, if you are a business user

  • you will not export, directly or indirectly, any technical data acquired from us under these terms and conditions and/or the Peak Community (or any products incorporating any such data) in breach of any applicable laws or regulations (Export Control Laws), including United States export laws and regulations and economic sanction policy or policies, to any country for which the government or any agency thereof at the time of export requires an export licence or other governmental approval without first obtaining such licence or approval; 

  • you represent, warrant and covenant that you will comply at all times with Export Control Laws; and

  • you represent, warrant and covenant that you will not permit you or anyone else to access or use the Peak Community in violation of any United States or other applicable export embargoes, prohibitions or restrictions or any Export Control Laws.

You must keep your account details safe

Before you can access certain parts or all of the Peak Community you may be required to complete a registration process by providing the information requested in a form. You must provide information which is complete, accurate, up-to-date and not misleading. We may rely on any information provided by you so it is important you comply with this requirement. You must tell us promptly about any changes to the information that you have provided to us. 

If you choose, use or you are provided with, a user identification code, your email address, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose your account details to any third party.

Peak has the right to disable any email address and/or user identification code and/or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms and conditions.

If you know or suspect that anyone other than you knows your email address, user identification code and/or password, you must promptly notify us at community@peak.ai. 

Confidentiality

You agree that you will not at any time, disclose to any person any confidential information concerning  our business, affairs, customers, partners, affiliates or suppliers or of any member of the group of companies to which we belong, except as permitted by the following paragraph. Any reference to confidential information means anything which is expressly marked as confidential, private, sensitive or similar or otherwise would reasonably be considered confidential in the circumstances. It does not extend to any information which is available in the public domain without any breach of this paragraph or to anything which is publicly posted in Peak Community outside of the Peak Platform support portal relating to specific support requests and responses. 

You may disclose our confidential information:

  • to your employees, officers, representatives, contractors, subcontractors or advisers who need to know such information for the purposes of exercising your rights or carrying out your obligations under or in connection with these terms and conditions. You shall ensure that your employees, officers, representatives, contractors, subcontractors or advisers to whom you discloses our confidential information comply with this paragraph; and

  • as may be required by law, a court of competent jurisdiction or any governmental or regulatory authority.

You shall not use our confidential information for any purpose other than to exercise your rights and perform your obligations under or in connection with these terms and conditions unless we have agreed otherwise in writing.

How you may use material on the Peak Community

Peak is the owner or the licensee of all intellectual property rights in the Peak Community, and in the material published on it. Those works are protected by copyright and other laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from the Peak Community for your personal use and you may draw the attention of others within your organisation to Content posted on the Peak Community.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of Content on the Peak Community must always be acknowledged (except where the Content is user-generated).

You must not use any part of the Content on the Peak Community for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy, download, share or repost any part of the Peak Community in breach of these terms and conditions, your right to use the Peak Community will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

No text or data mining, or web scraping

You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to the Peak Community or any services provided via, or in relation to, the Peak Community. This includes using (or permitting, authorising or attempting the use of):

  • any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the Peak Community or any data, Content, information or services accessed via the Peak Community; and/or

  • any automated analytical technique aimed at analysing text and data in digital form to generate information which includes patterns, trends and correlations.

The provisions in this paragraph should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of Digital Copyright Directive ((EU) 2019/790).

This paragraph shall not apply insofar as (but only to the extent that) Peak is unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.

Do not rely on information on the Peak Community

The Content on the Peak Community is provided by multiple contributors inside and outside of Peak for general information and discussion purposes only. It is not intended to amount to advice on which you or anyone else should rely unless a genuine Peak team member (as designated on our site) provides you with specific support advice in relation to the Peak Platform

You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of any Content or services on the Peak Community.

Subject to the section titled ‘Whether you are a consumer or a business user’ within Our responsibility for loss or damage suffered by you, all warranties, conditions, terms, undertakings or obligations whether express or implied and including any implied terms relating to quality, fitness for any particular purpose, reasonable care and skill or ability to achieve a particular result are excluded to the fullest extent allowed by applicable law.

Although Peak make reasonable efforts to update the information on the Peak Community, Peak make no representations, warranties or guarantees, whether express or implied, that: 

  • the Peak Community or the Content on the Peak Community is accurate, complete or up-to-date, relevant or appropriate for your circumstances, purposes or requirements;

  • the Peak Community or the Content on the Peak Community will always be available or be uninterrupted or error-free, or

  • defects on the Peak Community or any Content on the Peak Community will be corrected.

Peak is not responsible for websites we link to

Where the Peak Community contains links to other websites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. 

Peak has no control over (and has no liability to you or any third party if you use of or rely on) the contents of those websites or resources. You should always read the terms and conditions, privacy policy and cookie policy (as are available) for any other website or resource that you access.  

User-generated Content is not approved by us

The Peak Community will by its nature include information and materials uploaded by other users of the Peak Community, including to discussion and sub-group forums, surveys or polls, support contact in relation to our Peak Platform  which may include video and photo sharing facilities. This information and these materials have not been verified or approved by us. The views expressed by other users on the Peak Community do not represent our views or values.

How to complain about Content uploaded by other users

If you wish to complain about Content uploaded by other users, please either report the Content by flagging it in accordance with our Peak Community Acceptable Use Policy (below) or contact us on community@peak.ai

Our responsibility for loss or damage suffered by you

Whether you are a consumer or a business user:

  1. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

  2. Subject to paragraph 1 above, you use the Peak Community at your own risk and we shall not be liable for any errors, omissions or inaccuracies in or on the Peak Community. The Peak Community and any Content on the Peak Community is provided without any guarantees, conditions or warranties of any kind. 

  3. Whilst we will use reasonable endeavours to ensure the Peak Community does not contain any viruses or harmful code, you understand and agree that use of the Peak Community and any Content downloaded, used or otherwise obtained through the use of the Peak Community is downloaded and used at your own discretion and risk. Subject to paragraph 1 above, you acknowledge and agree that you will be solely responsible for all loss and damage, including damage to your own computer system and loss of data arising in connection with the download or use of such Content. 

Different limitations and exclusions of liability will apply to liability arising as a result of the supply or licence of any products or services including the Peak Platform to you, which will be set out in our order form(s) and licence terms that apply to the licence of the Peak Platform and the provision of any other services. Please consult those terms for details. 

If you are a business user: 

Subject to paragraph 1 above:

  • we exclude all implied conditions, warranties, representations or other terms that may apply to the Peak Community or any Content or services on it.

  • we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

    • use of, or inability to use, the Peak Community; 

    • use of or reliance on any Content displayed on the Peak Community; or

    • use of, or inability to use, any services via the Peak Community.

  • in particular, we will not be liable for:

    • loss of profits;

    • loss of sales;

    • loss of business;

    • loss of revenue;

    • loss of agreements or contracts;

    • business interruption;

    • loss of anticipated savings;

    • loss of business opportunity; 

    • loss of or damage to goodwill; 

    • loss of reputation; or

    • any indirect or consequential loss or damage.

Subject at all times to the rest of this section within the sub-heading ‘If you are a business user’, Peak’s total liability to you shall not exceed £10,000. 

If you are a consumer user:

  • Please note that we only provide the Peak Community for domestic and private use. You agree not to use the Peak Community for any commercial or business purposes, and Peak have no liability to you for any: 

    • loss of profit; 

    • loss of sales;

    • loss of business;

    • loss of revenue;

    • loss of agreements or contracts;

    • business interruption; 

    • loss of anticipated savings; 

    • loss of business opportunity; 

    • loss of or damage to goodwill; or

    • loss of reputation.

  • If defective digital content that we have supplied, damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. 

If you are a business user you indemnify us for losses

You will indemnify and hold Peak harmless against any loss, damages, claims, costs and expenses suffered or incurred by Peak arising from: 

  • use of the Peak Community by you or anyone to whom you permit to access the Peak Community in breach of these terms and conditions; or 

  • a claim that the intellectual property rights of a third party have been violated by you or anyone to whom you permit to access the Peak Community; or

  • a violation of applicable law in regard to the illegal posting of Content on the Peak Community.

If you are a business user this is our entire agreement with you

If you are a business user this Contract constitutes the entire agreement between you and us in relation to your use of the Peak Community. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty made or given by us or on our behalf which is not set out in this Contract and that you have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this Contract.

How Peak may use your personal information

Your privacy and personal information are important to us. Peak will only use your personal information as set out in our privacy policy.

Our Privacy Policy explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.

Uploading Content to the Peak Community

Whenever you make use of a feature that allows you to upload Content to the Peak Community, or to make contact with other users of the Peak Community, you must comply with the Content Standards set out in our Peak Community Acceptable Use Policy.

In addition, each time you submit or post Content on the Peak Community, you confirm and guarantee that your Content:

  • is your own original work and does not breach any third party’s intellectual property rights (for example, by including a company’s trade mark or another person’s work or content without permission);

  • complies with our Peak Community Acceptable Use Policy and does not breach any applicable law or regulation;

  • can be submitted to the Peak Community and published / used without breaching any contractual obligation to any person; and

  • does not contain anything which may be confidential or commercially sensitive.

You warrant that your Content complies with the Content Standards and the previous paragraph of these terms and conditions, and you will be liable to us and will cover us on a pound-for-pound (£) basis for any losses or damage that we may suffer for any breach of that warranty. This means you will be responsible for any loss or damage Peak suffers as a result of your breach of warranty.

If your Content on the Peak Community contains photographs or video images of people, you must ensure that you inform them that you intend to use the material on the Peak Community and obtain their consent. We may ask you for evidence of any such consent and reserve the right to delete / remove (in whole or in part) your Content if you are unable to provide it or if we have doubts about its adequacy.

Any Content you upload to the Peak Community will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your Content, but you are required to grant us and other users of the Peak Community a licence to use, store, modify, develop and copy that Content and to distribute and make it available to third parties and the rights you license to us are described in Rights you are giving us to use Content you upload.

Peak also have the right to disclose your identity to any third party who is claiming that any Content posted or uploaded by you to the Peak Community constitutes a violation of their intellectual property rights, or of their right to privacy.

Peak have the right to remove and delete, in whole or in part, and without notification to you, any Content you add or post on the Peak Community if, in our opinion, your Content does not comply with the Content Standards set out in our Peak Community Acceptable Use Policy or for any other reason that we at our sole discretion consider to be reasonable.You are solely responsible for securing and backing up your Content.

We may (but are not obliged to) monitor your activities (or be alerted to the same) on the Peak Community for any reason.

Rights you are giving us to use Content you upload or post

When you upload or post Content to the Peak Community, you grant the following rights in relation to that Content:

  • to us: a worldwide, non-exclusive, irrevocable, royalty-free, sub-licensable, transferable licence to use, store, reproduce, distribute, edit, modify, adapt, develop, copy, publish, republish, prepare derivative works of, incorporate into other materials, media or content, display, and perform that user-generated Content in connection with the Peak Community and the Peak Platform and across different media, exhibitions, publications and events including to promote the Peak Community the Peak Platform and/or our other services and products forever without naming you;

  • to our users and partners: a worldwide, revocable, non-exclusive, royalty-free, sub-licensable, transferable licence to use the Content for their purposes forever.

You irrevocably and unconditionally waive any moral rights in the Content that you post on the Peak Community to which you or any other individual is now or may be at any future time entitled under Chapter IV of Part I of the Copyright Designs and Patents Act 1988 as amended from time to time or any similar provision from time to time in force anywhere in the world. You undertake not to institute, support, maintain or permit any action or lawsuit in any part of the world on the grounds that the Content that you post on the Peak Community or any future related uses, including in relation to media, exhibitions, publications and events held anywhere in the world in any way constitute an infringement of your moral rights including on the grounds that you have not been identified as the author of the Content or on the grounds that the Content may have been subjected to a derogatory treatment. These waivers will be in favour of Peak and our licensees, sub-licensees, assignees and successors in title to the Content that you post on the Peak Community.

You are not entitled to any fees for granting the licences (the rights) you give to us and to our users and partners, and you are not entitled to terminate the licences unless we (or our users and partners, where applicable) agree in writing.

For the avoidance of doubt, if we use your Content in any way that incorporates your Content, for example in any other material, media, event or publication, as we are allowed by the licence you provide to us,:

  • you continue to own your Content; and

  • we or our licensors (as applicable) own all other rights, including intellectual property rights, in the creation.  

Peak is not responsible for viruses and you must not introduce them

Peak does not guarantee that the Peak Community will be secure or free from bugs or viruses.

You are responsible for configuring your information technology including computer programmes, website and devices to access the Peak Community. You should use your own virus protection software.

You must not misuse the Peak Community by knowingly introducing, posting, transmitting, uploading, linking to, sending or storing any viruses, malware, trojan horses, worms, time bombs, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Peak Community, the server on which the Peak Community is stored or any server, computer or database connected to the Peak Community. You must not attack the Peak Community via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. Peak will report any such breach to the relevant law enforcement authorities and Peak will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Peak Community will cease immediately.

Rules about linking to the Peak Community

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

The Peak Community must not be framed on any other website, nor may you create a link to any part of the Peak Community other than the home page.

Peak reserve the right to withdraw linking permission without notice.

The website in which you are linking must comply in all respects with the Content Standards set out in our Peak Community Acceptable Use Policy.

If you wish to link to or make any use of Content on the Peak Community other than that set out above, please contact community@peak.ai 

Nobody else has any rights under this Contract between you and Peak

This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

If a court invalidates some of this Contract, the rest of it will still apply 

If a court or other authority decides that some of these terms and conditions are unlawful, the rest will continue to apply.

If any provision or part-provision of these terms and conditions is or becomes invalid, illegal or unenforceable, it will be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this paragraph will not affect the validity and enforceability of the rest of these terms and conditions.

Even if we delay in enforcing this Contract, we can still enforce it later

Peak might not immediately chase you for not doing something or for doing something you're not allowed to, but that doesn’t mean we can't do it later.

Which country's laws apply to any disputes?

If you are a consumer, please note that these terms and conditions, their subject matter and their formation, are governed by English law. You and Peak both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms and conditions, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. You and Peak both agree to the exclusive jurisdiction of the courts of England and Wales.

Our trade marks

Peak, Enterprise AI and  are all UK registered trade marks of Peak AI Limited. is an unregistered trade mark of Peak AI Limited. You are not permitted to use any of our trade marks without our prior written approval, unless it is part of material you are using as permitted under the paragraph titled "How you may use material on the Peak Community" above.

What's in these terms?

This acceptable use policy (this Policy) sets out the content standards that apply when you upload content to our Peak Community at https://community.peak.ai/ ("Peak Community" or "our site"), make contact with other users of the Peak Community, link to our site, or interact with our site in any other way.

If you would like to report user activity or content which you believe does not adhere to the Content Standards set out in this Policy, please flag it by clicking on the three dots at the bottom of the post and clicking “flag”. This will then be reviewed by a moderator.  

By using the Peak Community you accept these terms

By using our site, you confirm that you accept the terms of this Policy and that you agree to comply with them.

If you do not agree to this Policy, you must not use the Peak Community.

Prohibited uses

You must not use the Peak Community:

  • in any way that breaches any applicable local, national or international law or regulation;

  • in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect;

  • for the purpose of harming or attempting to harm minors in any way;

  •      to bully, insult, intimidate or humiliate any person or  produce any content that      directly or indirectly supports activities that are racist, hateful, abusive, libelous, obscene, or discriminatory;          

  • to send, knowingly receive, upload, download, use or re-use any material which does not comply with our Content Standards;

  • to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);

  • to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware; and/or

  • to upload terrorist content.

You also agree:

  • not to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of our Peak Community terms and conditions;     

  •      not to modify, adapt, or hack or otherwise attempt to gain unauthorised access to the Peak Community; and 

  • not to access without authority, interfere with, damage or disrupt:

    • any part of our site;

    • any equipment or network on which our site is stored; 

    • any software used in the provision of our site; or 

    • any equipment or network or software owned or used by any third party.

Interactive services

The nature of the Peak Community is to encourage interaction between all users of our site and us. Interactive services on our site, may include: 

  • video and photo-sharing facilities;

  • discussion and sub-group forums; 

  • surveys or polls; 

  • support contact in relation to the Peak Community; and 

  • event registration,      

(interactive services).

The Peak Community will be moderated on a regular basis. 

We will do our best to assess any possible risks for users (and in particular, for children) from third parties when they use each interactive service provided on the Peak Community, and we will decide in each case what kind of moderation of the relevant service to use in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interaction on our site, and we expressly exclude our liability for any loss or damage arising from the use of the Peak Community by a user in contravention of our Content Standards, whether the relevant interactive service is moderated or not. 

The use of the Peak Community by a minor is subject to the prior consent of their parent or guardian. We advise parents who permit their children to use the Peak Community that it is important that they communicate with their children about their safety online, as moderation is not fool proof. Minors who are using any interactive service should be made aware of the potential risks to them. 

We do not store terrorist content.

Content Standards

These Content Standards apply to any and all material which you contribute to the Peak Community (Contribution), and to any interactive services associated with it. 

The Content Standards must be complied with in spirit as well as to the letter. The standards apply to each part of any Contribution as well as to its whole.

Peak will determine, in its discretion, whether a Contribution breaches the Content Standards.

A Contribution must:

  • be accurate (where it states facts);

  • be genuinely held (where it states opinions); and

  • comply with the law applicable in England and Wales and in any country from which it is posted.

A Contribution must not:

  • identify any specific use case of the Peak Platform, its applications or any other services which we may have provided to you or one of your group companies or affiliates as a Peak customer or partner which are subject to confidentiality obligations     ;  

  • be defamatory of any person;

  • be obscene, offensive, hateful or inflammatory;

  • bully, insult, intimidate or humiliate;

  • promote sexually explicit material;

  • include child sexual abuse material;

  • promote violence;

  • promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

  • infringe any copyright, database right or trade mark of any other person;

  • be likely to deceive any person;

  • breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence;

  • promote any illegal content or activity;

  • be in contempt of court;

  • be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety;

  • be likely to harass, upset, embarrass, alarm or annoy any other person;

  • impersonate any person or misrepresent your identity or affiliation with any person. In particular, it is strictly prohibited for any user to impersonate an employee, consultant, contractor of Peak or to falsely claim to have any affiliation or other relationship with Peak or any of our third party service providers including Insided Inc or Insided BV;

  • give the impression that the Contribution emanates from Peak, if this is not the case;

  • advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (for example only) copyright infringement or computer misuse;

  • contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism; or

  • contain any advertising.

You may link to other websites, as permitted in accordance with our Peak Community Terms and Conditions, but you should not make what we may, acting reasonably, consider to be an excessive amount of links to third party websites. 

For the avoidance of doubt, for any Contribution in the form of video content:

  • you must tell us immediately, if you upload a video containing any of the following: criminal material, unclassified or unclassifiable videos, videos rated R18 or suitable for R18 rating and other material that might impair the physical, mental or moral development of persons under the age of 18 (restricted material);

  • you must not upload a video containing harmful material;

you must not upload a video containing advertising Any video you upload must not:

  • prejudice respect for human dignity;

  • include or promote discrimination based on sex, racial or ethnic origin, nationality, religion or belief, disability, age or sexual orientation;

  • encourage behaviour prejudicial to health or safety;

  • encourage behaviour grossly prejudicial to the protection of the environment;

  • cause physical, mental or moral detriment 

  • directly exhort such persons to purchase or rent goods or services in a manner which exploits their inexperience or credulity;

  • directly encourage such persons to persuade their parents or others to purchase or rent goods or services;

  • exploit the trust of any person; or

  • unreasonably show any person in dangerous situations.

You must use the functionality provided on our site to declare whether, as far as you know or can reasonably be expected to know, any video contains advertising.

Breach of this Policy

When we consider that a breach of this Policy has occurred, we may take any action as we deem appropriate.  

Failure to comply with this Policy constitutes a material breach of the Peak Community terms and conditions upon which you are permitted to use Peak Community, and may result in our taking all or any of the following actions:

  • immediate, temporary or permanent withdrawal of your right to use our site;

  • immediate, temporary or permanent removal of any Contribution uploaded by you to our site;

  • issue of a warning to you;

  • legal proceedings against you for reimbursement of all costs and losses that we or third parties suffer on a pound-for-pound basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;

  • further legal action against you; and/or

  • disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.

We exclude our liability for all action we may take in response to breaches of this Policy. The actions we may take are not limited to those described above, and we may take any other action we reasonably think is appropriate.

How this contract can be transferred

We can transfer our rights and obligations under this Policy to any third party, provided this does not adversely affect your rights under this Policy.

Which country's laws apply to any disputes?

If you are an individual consumer, please note that the terms of this Policy, its subject matter and its formation are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business or accessing the Peak Community on behalf of a business, the terms of this Policy, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
